California Privacy Notice (CPRA)

Effective Date: May 1st, 2025

This California Privacy Notice (“Notice”) supplements the JobzMall Privacy Policy and applies solely to visitors, users, and others who reside in the State of California (“consumers” or “you”). We adopt this Notice to comply with the California Consumer Privacy Act of 2018 (CCPA), as amended by the California Privacy Rights Act of 2020 (CPRA).

1. Categories of Information We Collect

In the preceding 12 months, JobzMall has collected the following categories of Personal Information. We obtain this information directly from you, indirectly through your device/activity, and from third parties (e.g., references or employers).
  1. Identifiers: Real name, alias, postal address, unique personal identifier, online identifier, IP address, email address, and account name.
  2. Personal Information (Cal. Civ. Code § 1798.80(e)): Name, signature, telephone number, employment history, and education.
  3. Protected Classification Characteristics: Age (40+), race, color, ancestry, national origin, citizenship, sex, and veteran status. (Note: Collection isoptional and primarily for your own profile building or diversity monitoring requested by Employers. JobzMall does not use this data for its own employment decisions regarding users).
  4. Commercial Information: Records of products or services purchased, obtained, or considered (e.g., subscription history).
  5. Biometric Information: We do not collect biometric identifiers or biometric information for the purpose of uniquely identifying you (e.g., faceprints or voiceprints).
  6. Internet or Network Activity: Browsing history, search history, and information on your interaction with our website, application, or advertising.
  7. Geolocation Data: Physical location or movements (derived roughly from IP address).
  8. Sensory Data: Audio, electronic, visual, thermal, or similar information (e.g., Profile Videos, Video Cover Letters, interview recordings, Customer Support calls).
  9. Professional or Employment-Related Information: Current or past job history, resumes, work-related information provided by you, and reference responses.
  10. Education Information: Education information provided by you (e.g., schools attended, transcripts uploaded by users).
  11. Inferences: Profiles reflecting a person's preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes (e.g., Job matching scores).
  12. Sensitive Personal Information (SPI): Account credentials (e.g., log-in and authentication information) allowing access to an account; Racial or ethnic origin (if provided); Contents of messages sent strictly through the JobzMall platform (where applicable).
2. Purposes for Collection

We use the Personal Information listed above for the following business purposes:
  • Providing and optimizing the JobzMall Services (connecting Talent with Employers).
  • Processing applications, subscriptions, and transactions.
  • Debugging to identify and repair errors.
  • Detecting security incidents and protecting against malicious activity.
  • Advertising and marketing (including measuring and improving advertising performance).
  • Performing services on behalf of the business or service provider (e.g., customer service, analytics).
3. Disclosure of Personal Information

We may disclose your Personal Information to a third party for a business purpose. When we disclose Personal Information for a business purpose, we enter a contract that describes the purpose and requires the recipient to keep that personal information confidential and not use it for any purpose except performing the contract.

In the preceding 12 months, we have disclosed the following categories of Personal Information for a business purpose to the following categories of third parties:
  • Service Providers: (Hosting, Payment Processors, Analytics) – Categories A, B, D, F, G.
  • Service Providers (Authentication, Security, and Support Communications):– Category L (to the extent necessary for authentication, account security, customer support, and operation of platform messaging and support tools).
  • Employers/Recruiters: (For hiring purposes) – Categories A, B, C, H, I, J, K.
  • Ad Networks/Data Partners: (For marketing) – Categories A, F, G, K.
Note: We do not disclose Sensitive Personal Information (Category L) to third parties except to service providers as strictly necessary to provide the Services.

4. Sale and "Sharing" of Personal Information

Under the CPRA, the definitions of "Sell" and "Share" are very broad and cover many common internet technologies.
  • "Selling" may include making your profile available to Employers who pay for access to our Database, or transferring data to third parties for valuable consideration.
  • "Sharing" includes allowing third-party advertising cookies (e.g., Google, Meta) to collect data on your browsing behavior to show you relevant ads on other sites (Cross-Context Behavioral Advertising).
JobzMall may "Sell" or "Share" Personal Information as defined by California law.
  • Categories Sold/Shared: Identifiers (A), Internet Activity (F), Professional Information (I), Inferences (K).
  • Your Right to Opt-Out: You have the right to direct us to not sell or share your Personal Information at any time (the "Right to Opt-Out").
  • How to Opt-Out: You may adjust your privacy settings in your Account Dashboard or click the "Do Not Sell or Share My Personal Information" link at the footer of our website. Where required by law, we also process opt-out preference signals such as the Global Privacy Control (GPC).
  • Talent Bank Visibility: Professional or employment-related information is included in “Sold” or “Shared” categories only when a user affirmatively chooses to make their profile visible in the JobzMall Talent Bank, which allows paying employers to view such profiles. Users may opt out of the Talent Bank at any time through their account settings, which will remove their profile from paid employer access.
  • Impact on Job Applications: If you opt out of "Selling/Sharing, " we may still disclose your information to employers when you direct us to do so (e.g., by applying to a job, contacting an employer directly, or setting your profile to "Public"). Such disclosures are at your direction and generally are not treated as a "Sale" under the CPRA.
5. Your Rights and Choices

The CPRA provides consumers (California residents) with specific rights regarding their Personal Information:
  1. Right to Know and Data Portability You have the right to request that we disclose certain information to you about our collection and use of your Personal Information over the past 12 months, including the categories of Personal Information collected, the sources, the purposes for collection, the categories of third parties to whom we disclose it, and the specific pieces of information we have collected.
  2. Right to Delete You have the right to request that we delete any of your Personal Information that we collected from you and retained, subject to certain exceptions (e.g., if we are required to retain it by law, to prevent fraud, or to complete a transaction).
  3. Right to Correct You have the right to request that we correct inaccurate Personal Information that we maintain about you.
  4. Right to Limit Use of Sensitive Personal Information JobzMall uses Sensitive Personal Information (e.g., log-in credentials) solely for purposes permitted under the CPRA and its implementing regulations (e.g., to perform the services reasonably expected by an average consumer). Therefore, we are not required to provide a "Limit the Use of My Sensitive Personal Information" link.
  5. Automated Decision-Making We may use automated tools to recommend jobs or candidates; however, these tools provide recommendations only and do not make final hiring decisions, which are made solely by Employers.
  6. Right to Non-Discrimination We will not discriminate against you for exercising any of your CPRA rights.
6. Exercising Your Rights

To exercise the rights described above, please submit a verifiable consumer request to us by:Verification: We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request. We will only use Personal Information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

Authorized Agent: You may designate an authorized agent to make a request on your behalf. We may require proof of your written authorization and verify your identity directly to ensure the agent is acting with your permission.

Response Timing: We endeavor to respond to a verifiable consumer request within45 days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.

7. Data Retention

We retain Personal Information only for as long as is reasonably necessary to fulfill the purposes for which it was collected or to comply with legal obligations. Retention periods vary based on the nature of the data, our legal obligations, and operational needs (e.g., security, fraud prevention, dispute resolution).
  • Active Accounts: Retained for the duration of the account life to facilitate career history and re-hiring.
  • Deleted Accounts: Generally deleted from production within 30 days and removed from backups within 90 days, subject to legal holds and operational constraints.
  • Video Content: Retained until the user deletes the content or the account is terminated.

8.8. "Shine the Light" Law

California Civil Code Section 1798.83 permits users of our Website that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please send an email to  [email protected].
